Gardaí Face Trial for Alleged Penalty Points Fixing Scheme
UPDATE: A major trial involving five members of the Gardaí has just commenced at the Limerick Circuit Criminal Court, where they face serious allegations of fixing penalty points for prominent sporting personalities. The jury, comprising eight men and four women, was empaneled earlier today, with proceedings expected to last up to six weeks.
The accused include retired Superintendent Eamon O’Neill, Sergeant Michelle Leahy, Sergeant Anne-Marie Hassett, Garda Tom McGlinchey, and Garda Colm Geary. All five defendants have pleaded not guilty to five representative charges out of a total of 42 charges regarding attempts to pervert the course of justice related to fixed penalty charge notices. Key allegations involve squaring away charges for offences like speeding, using a mobile phone while driving, and failing to wear seatbelts.
The prosecution, led by Carol Hanahoe SC, initially estimated the trial’s duration at one month. However, defense attorney Felix McEnroy SC raised concerns about the increased number of witnesses, suggesting the timeline could be extended. The extensive witness list exceeds 40 Gardaí personnel, including chief superintendents and civilian witnesses from the Department of Transport and An Post.
The trial’s opening remarks were marked by procedural delays, with Judge Colin Daly apologizing for the late start of jury selection, which began at 11:22 AM instead of the scheduled time of 8:30 AM. He emphasized that jury duty exemptions are strictly regulated, only allowing for significant reasons such as medical appointments or work commitments.
Witness testimonies are expected to delve into the controversial practices alleged to have occurred between October 2016 and September 2019. The implications of this trial are significant, not only for the individuals involved but also for public trust in law enforcement.
