Nephew of Gerry ‘The Monk’ Hutch Discharged After Aggressive Incident
UPDATE: Nathan Hutch, the nephew of notorious crime figure Gerry ‘The Monk’ Hutch, has had his conviction for public intoxication and aggressive behavior towards Gardaí discharged following an urgent appeal. This significant development occurred on May 9, 2023, in Dublin, revealing troubling insights into Hutch’s tumultuous life.
The District Court Appeals Court ruled that Hutch, 32, who previously pleaded guilty to being intoxicated in a public place, demonstrated “extremely aggressive” behavior while interacting with law enforcement. Hutch’s initial conviction involved charges under the Criminal Justice (Public Order) Act, 1994, including threats and abusive language directed at Gardaí.
On the morning of the incident at 10:10 AM, Hutch reportedly fled from officers near Talbot Street, admitting to consuming cocaine and sleeping tablets. Sergeant Lee Kelly, who testified during the appeal, detailed Hutch’s aggression and noted his extensive criminal record, which includes 104 previous convictions, primarily for road traffic violations.
Defending Hutch, solicitor Andrew Molony emphasized the profound personal struggles his client has faced, including the tragic murder of his brother in 2018. Molony described Hutch as a young man battling severe trauma and anxiety, advocating for continued treatment to address these issues rather than further incarceration.
Judge Deirdre Browne ultimately decided to discharge Hutch under Section 1(1)(ii) of the Probation of Offenders Act, 1907, mandating that he maintain peace and good behavior for the next three years. Hutch is also required to engage with probation services for 12 months post-release, adhering to all guidance provided. Any breach of these terms will result in a return to court for conviction and sentencing.
This ruling highlights ongoing challenges within the criminal justice system, particularly concerning individuals grappling with trauma and addiction.
