New Law to Ban ‘Sex-for-Rent’ Set for Early 2026 in Ireland
UPDATE: New legislation aimed at banning the controversial practice of ‘sex-for-rent’ is set to be introduced in the Dail early in 2026. This urgent measure comes as authorities confirm a growing concern over landlords exploiting vulnerable individuals for accommodation.
Justice Minister Jim O’Callaghan announced that the proposed legislation will impose strict penalties on landlords who request sexual favors in exchange for housing. Offenders could face fines of up to €5,000 for both offering and advertising such arrangements. This decisive action follows a 2025 report from the National Women’s Council, highlighting the alarming prevalence of ‘sex-for-rent’ demands, particularly targeting foreign female students in need of housing.
In a statement responding to questions from TD Cian O’Callaghan, Minister O’Callaghan emphasized the need for such legislation, stating,
“Any attempt by accommodation providers to exploit their position and prey on vulnerable individuals through such ‘sex for rent’ arrangements is completely unacceptable.”
He described these actions as an abuse of power that will not be tolerated.
The proposed bill, known as the General Scheme of the Criminal Law and Civil Law 2025, includes two specific criminal offenses. These are offering accommodation in exchange for sexual activity and promoting such arrangements through advertising. The legislative details have already been forwarded to the Office of Parliamentary Counsel for formal drafting, and the Joint Committee on Justice, Home Affairs and Migration has reviewed the measures.
The committee conducted a pre-legislative scrutiny hearing on 30 September 2025, with the Report published on 13 November 2025. Following government approval on 16 December 2025, Minister O’Callaghan is set to bring this critical legislation before the House of the Oireachtas in the coming weeks.
This development is crucial for protecting vulnerable individuals who may feel pressured in dire housing situations. As the housing crisis continues to escalate, the introduction of this law has the potential to significantly impact the rental market, ensuring safer living conditions for all.
