UK Bans Non-Consensual Sexual Images Following Grok AI Concerns

Generating non-consensual sexual images will soon be illegal in the United Kingdom as the government intensifies its response to the AI chatbot Grok. This decision follows the launch of an investigation by the media regulator, Ofcom, into allegations that the social media platform X has violated UK law by allowing Grok to create “undressed images.”

British Technology Secretary Liz Kendall announced that the new criminal offence will be implemented this week under the Data (Use and Access) Act, which was passed by Parliament in 2022. The specific date of enforcement has not been disclosed, but it marks a significant step in addressing concerns around the misuse of AI technology in generating explicit content without consent.

Legislation Targets Problem at Its Source

As part of ongoing legislative efforts, nudification applications will also face criminalization under the Crime and Policing Bill, which is currently progressing through Parliament. This legislation aims to prohibit companies from supplying tools that facilitate the creation of non-consensual images online. Kendall emphasized that this approach targets the issue “at its source.”

In related developments, British Prime Minister Keir Starmer issued a warning to Elon Musk’s X, suggesting that the platform could lose its “right to self-regulate” if it fails to manage Grok effectively. During a session with Labour MPs, Starmer stated, “If X cannot control Grok, we will – and we’ll do it fast because if you profit from harm and abuse, you lose the right to self-regulate.” This statement underscores the government’s pressure on X to comply with UK regulations.

Government Oversight and Potential Penalties

The controversy surrounding Grok has prompted calls for the UK government to reconsider its engagement with the platform. Downing Street confirmed on Monday that it is reviewing its presence on X in light of the ongoing issues. The widespread use of Grok for generating sexually explicit content has raised alarms among ministers, and there is growing support for a ban if Ofcom decides to restrict access to the platform.

Should X fail to adhere to UK regulations under the Online Safety Act, Ofcom has the authority to impose fines of up to 10% of global revenue or £18 million. In extreme situations, the regulator can seek court approval to block access to the site entirely.

Grok, developed by xAI, a company founded by Musk, introduced its advanced image generation feature in July 2022. However, the recent surge in its use for creating nude deepfake images has sparked significant concern. Ofcom’s investigation aims to determine whether X has fulfilled its obligation to protect users in the UK from illegal content. The regulator stated, “There have been deeply concerning reports of the Grok AI chatbot account on X being used to create and share undressed images of people – which may amount to intimate image abuse or pornography – and sexualized images of children that may amount to child sexual abuse material.”

In response to these threats, Musk has characterized the UK government’s actions as “fascist,” claiming they threaten free speech. This ongoing debate highlights the complex balance between technological advancement and regulatory oversight in the digital age, particularly regarding sensitive issues like consent and image rights.
