Ghislaine Maxwell is actively pursuing an appeal of her 2021 conviction for sex trafficking, aiming to present her case to the Supreme Court. Maxwell’s attorney, David Oscar Markus, has emphasized the importance of honoring legal agreements. He referenced a 2007 plea deal that Epstein negotiated, which reportedly provided immunity to certain co-conspirators in exchange for pleading guilty to state-level sex crimes. Markus stated, “President Trump built his legacy in part on the power of a deal — and surely he would agree that when the United States gives its word, it must stand by it.”

The plea agreement was reached with the Southern District of Florida following Epstein’s initial accusations in 2005. The deal included language that extended coverage to “any potential co-conspirators,” a point that Maxwell’s attorneys argue should include her, despite her name not being specifically mentioned. The court filing from Monday asserts that the language used by the government implies an intent to protect unnamed individuals involved in Epstein’s offenses.

Maxwell’s appeal also underscores her belief that it is unjust to hold her accountable for Epstein’s crimes, particularly given the commitments made by the government. The document states, “We are appealing not only to the Supreme Court but to the President himself to recognize how profoundly unjust it is to scapegoat Ghislaine Maxwell for Epstein’s crimes, especially when the government promised she would not be prosecuted.”

The Justice Department contends that Maxwell was not a party to the original agreement and only Epstein was covered under the terms negotiated with the Florida U.S. Attorney’s office. In 2022, Maxwell was sentenced to 20 years in prison for her role in the trafficking operation and is currently incarcerated at a low-security facility in Tallahassee.
