AlphaSights Initiates Lawsuit Against AlphaSense for Trademark Infringement
																								
												
												
											AlphaSights Ltd, a company registered in England and Wales, has filed a lawsuit against AlphaSense Inc and its subsidiary Tegus Ltd for alleged trademark infringement. The case has been admitted to the fast track commercial list in the Commercial Court, where it will be presided over by Mr Justice Mark Sanfey. The legal action arises from claims that the name used by AlphaSense is confusingly similar to that of AlphaSights, which provides expert network services to a wide range of businesses.
The lawsuit was initiated following an affidavit submitted by Naida Khan, managing counsel based in London for AlphaSights. In her statement, Khan emphasized that the confusion stemming from AlphaSense’s operations has reached an “intolerable” level. She noted that this ongoing confusion has significantly harmed AlphaSights’ brand, resulting in misdirected communications, such as emails and invoices sent to the wrong company in both the US and the UK.
In her affidavit, Khan detailed the adverse effects of this confusion, highlighting that the scale and frequency of the issues continue to escalate. The situation has been aggravated by a recent conference organized by AlphaSense in New York, named the Alphasummit, which was intended for a global audience. This event has further blurred the lines between the two companies, leading to an increase in instances where clients and partners mistakenly engage with the wrong organization.
In its legal proceedings in Ireland, AlphaSense is not only contesting the trademark infringement but is also seeking damages and an injunction to prevent AlphaSights from passing off its trademark. The outcome of this case could have significant implications for both companies, particularly concerning brand identity and market positioning.
The ongoing legal battle adds to the complexities of a broader dispute, as AlphaSense and AlphaSights are already involved in litigation in both the United States and England. The resolution of these cases will likely influence the future operations of both firms within their respective markets.
