Celebrity Chef Donal Skehan Faces Compliance Notice for Misleading Post

Celebrity chef Donal Skehan has been issued a compliance notice by the Competition and Consumer Protection Commission (CCPC) after failing to properly disclose a paid promotion on his Instagram account. The notice, dated July 28, 2023, highlights the importance of transparency in social media advertising, particularly for influencers with substantial followings, such as Skehan, who boasts over 650,000 followers.
The CCPC determined that Skehan did not use appropriate labels to inform his audience that his post was sponsored by Wind Shore Goods, a business based in Howth that specializes in olive oils, condiments, and ceramics. As part of the compliance notice, Skehan was instructed to ensure that all future promotional content is clearly marked as such, adhering to consumer protection laws that prohibit misleading advertising practices.
Influencers are required to transparently disclose any paid promotions, as failing to do so can lead to breaches of consumer protection regulations. The CCPC emphasized that even properly labeled posts could still violate these laws if the content itself is false or misleading. This recent enforcement action follows a similar case involving former Irish rugby player Brian O’Driscoll, who also faced scrutiny for not disclosing paid content on social media.
Strengthening Oversight on Social Media Advertising
The issuance of the compliance notice to Skehan coincides with a new data-sharing agreement between the CCPC and the Advertising Standards Authority (ASA). This agreement enables the ASA to share information about potential advertising breaches reported by the public, thereby enhancing the CCPC’s ability to monitor compliance with consumer protection laws.
Patrick Kenny, a representative of the CCPC, stated, “Content from influencers must be clearly labelled as such and must also not be misleading.” The collaboration between the CCPC and ASA aims to foster a more accountable environment for social media advertising, ensuring that consumers are protected from unfair marketing practices.
Orla Twomey, Chief Executive of the ASA, described the agreement as a significant advancement for regulatory outcomes in Ireland. She noted, “This marks a significant step towards enhancing regulatory outcomes for consumers in Ireland, ensuring a strong, responsive and resilient framework for the future.”
The CCPC possesses various enforcement tools to uphold consumer protection laws, including compliance notices, fixed payment notices, and prohibition orders. The emphasis on transparency in advertising is becoming increasingly critical as the influence of social media continues to grow, prompting regulators to take decisive action against non-compliance.
As the landscape of digital marketing evolves, both influencers and brands must remain vigilant in adhering to established guidelines, ensuring that consumers are fully informed about the nature of the content they engage with online. The CCPC’s actions serve as a reminder that accountability in advertising is essential for maintaining trust in the marketplace.
