Inquiry Reviews Allegations Against Nurse Over Misuse of Painkillers
Allegations against a nurse regarding the unauthorized access and use of prescription painkillers, including a controlled substance, are under review by a fitness-to-practice committee. The inquiry, which concluded on October 15, 2023, examined events from October 14-15, 2020, when the nurse reportedly accessed OxyNorm, a medication containing Oxycodone, at a private general hospital without a valid prescription.
The nurse, whose identity remains confidential due to an order from the committee, is accused of not only taking OxyNorm but also various other medications that were not prescribed for her use. It is alleged that she self-administered some of these medications. The inquiry was conducted by the Nursing and Midwifery Board of Ireland (NMBI), which aims to ensure the safety and integrity of nursing practice in Ireland.
During the hearing, the nurse attended online without legal representation and admitted to the allegations, acknowledging that her actions constituted professional misconduct and violated the code of conduct for nurses. Evidence presented included testimonies from several key figures in the nursing department, such as the director of nursing and the assistant director of nursing, alongside a clinical nurse manager and a chief pharmacist. This evidence was accepted by both parties involved.
Legal Considerations and Committee Findings
The legal assessor provided critical insight during the proceedings, noting that while many facts of the case were agreed upon, the committee needed to determine whether the presented evidence could be classified as proven. He emphasized the need for a clinical approach to the evidence, particularly as one party lacked legal representation.
Moreover, the legal assessor discussed the legislative definition of a “relevant medical disability,” which includes physical or mental conditions that could impair a practitioner’s ability to perform their duties. He indicated that the committee must be convinced beyond a reasonable doubt that the nurse had a mental disability, potentially related to substance abuse, that could affect her professional capabilities.
The committee was advised that any sanction imposed should be proportionate to the findings, taking into account both aggravating and mitigating factors. The barrister representing the chief executive of the NMBI described the nurse’s behavior as “serious and potentially involving dishonesty.” A potential mitigating factor highlighted was the significant restrictions already placed on the nurse’s ability to practice.

As the inquiry concluded, the committee chair announced that its findings would be disclosed on a future date, leaving the outcome of the investigation pending. The proceedings underscore the seriousness of the allegations and the potential implications for the nurse’s professional future.
