Spain’s Attorney General Suspended for Data Leak in Landmark Case
Spain’s Supreme Court has suspended Attorney General Álvaro García Ortiz for two years following a guilty verdict for leaking confidential information. This landmark case marks the first time in Spain’s modern history that a high-ranking prosecutor has faced a criminal trial. The court ruled in a 5-2 decision, which was announced on March 14, 2024, although the complete verdict has not yet been made public.
The leak involved personal data regarding Alberto González Amador, the partner of Isabel Díaz Ayuso, a prominent opposition leader and the regional president of Madrid. The information was disclosed while González Amador was under investigation for alleged tax fraud, which remains unresolved. García Ortiz reportedly leaked an email to journalists and issued a press release that included sensitive personal details about González Amador.
Prime Minister Pedro Sánchez, who had previously defended García Ortiz during the lengthy investigation and trial, faces a setback with this ruling. The Spanish government stated that it respects the court’s decision but does not agree with it. In light of the ruling, the government has announced plans to initiate the process of appointing a new attorney general in the coming days.
In addition to his suspension, the court has ordered García Ortiz to pay a fine of €7,200, along with €10,000 in damages to González Amador, as well as covering court fees. García Ortiz has denied any wrongdoing and retains the option to appeal the decision to the Constitutional Court.
This case has captivated Spanish media, highlighting significant concerns regarding the handling of personal data by public officials. The suspension is not only a legal consequence for García Ortiz but also raises questions about the integrity and accountability of high-ranking officials in Spain.
