Englishman Jailed for Failing to Pay €5,000 Assault Compensation

UPDATE: An Englishman has been sentenced to prison after failing to pay compensation to his assault victim. Mark Fail, aged 37, was handed a six-month prison sentence due to non-compliance with court-ordered restitution in Clonakilty, West Cork.
In a hearing today, Judge Joanne Carroll confirmed that Fail’s failure to pay the €5,000 compensation—a condition of his previously suspended sentence—triggered his immediate incarceration. Fail’s conviction stems from a brutal incident in September 2023, where he launched an unprovoked attack on a victim, repeatedly punching and kicking him, resulting in significant injuries.
During the violent assault, the victim suffered a bloody nose and severe bruising, necessitating hospital treatment. In his victim impact statement, he revealed the psychological aftermath of the attack, stating he now struggles with post-traumatic stress disorder (PTSD) and fears going out alone at night.
Judge Carroll emphasized the severity of the assault, noting Fail’s lack of effort to fulfill the compensation requirement. “This was a very serious assault,” she stated, highlighting that Fail arrived in court without any means of compensation once again.
Fail, who resides on Molaga St in Clonakilty but is originally from England, had previously pleaded guilty to the charges in February. His suspended sentence was seen as a chance for rehabilitation, but Judge Carroll indicated that his non-compliance leaves her with no choice but to enforce the prison term.
