Investigation Launched After Charges Dropped Against Army Officer

An investigation has been initiated into the circumstances surrounding the criminal charges faced by Captain Alan Kearney, a respected member of the Defence Forces. The charges, which spanned over two years, were ultimately dropped due to a lack of evidence. Captain Kearney’s ordeal raises serious concerns regarding the treatment of military personnel within the Defence Forces.
In 2021, Captain Kearney was poised for a promotion to the prestigious position of Captain of the Guard in the Houses of the Oireachtas. Instead, he was relieved of his duties and underwent a search of his home by An Garda Síochána. He faced a total of 12 criminal charges, stemming from WhatsApp messages exchanged with a former colleague who later made protected disclosures regarding alleged misconduct within the Garda. This case has gained attention in recent months as it was discussed in the Oireachtas.
After enduring the weight of these charges for two and a half years, Captain Kearney was finally vindicated when the allegations were dropped. Alan Mahon, the Ombudsman for the Defence Forces, expressed concern over the treatment of Captain Kearney, describing the information presented to him as “disturbing.” He recommended that Kearney should receive the promotion he was denied while facing these serious charges.
Despite the Ombudsman’s recommendation for backdating the promotion by three years, the Defence Forces only agreed to backdate it by nine months. This decision has led to further scrutiny of the Defence Forces’ handling of the case. The Ombudsman noted that the prolonged nature of the charges had caused Captain Kearney significant stress and health issues. He emphasized that “being the subject of serious criminal charges for well in excess of two years have caused him enormous stress and occasional ill health.”
Captain Kearney’s experiences highlight the need for accountability within the Defence Forces. He spoke candidly to the Irish Examiner about the emotional toll the situation took on him and his family during their most difficult times. “When my mother died, when my wife fought cancer — our family’s lowest moments — that was when the Defence Forces chose to apply its maximum pressure,” he stated. “Their silence in the face of our distress was their answer. It was not a mistake; it was a strategy.”
In July 2023, after the ordeal and feeling unsupported, Captain Kearney resigned from the Defence Forces and now works abroad. A spokesperson for the Defence Forces reiterated their commitment to following due process in all matters, while the Ombudsman’s office indicated that they do not confirm or deny individual complaints.
As the investigation into Captain Kearney’s treatment continues, it underscores the ongoing need for reform and transparency in military justice and personnel management. The implications of this case may prompt a broader discussion on how the Defence Forces handle allegations against their members and the support systems in place for those facing such serious charges.
