UPDATE: Five bus and taxi operators are currently on trial for alleged anti-competition practices in school transport services across five counties in Ireland. The trial, which began today at the Central Criminal Court, has drawn significant attention as all five defendants pleaded not guilty to charges under the Competition Act 2002.

The accused, who are from County Tipperary, face a single charge that they engaged in a concerted practice aimed at preventing, restricting, or distorting competition in the provision of school transport services between November 1, 2014, and December 31, 2016. This case has been brought forth by the Competition Authority, and the trial is anticipated to last up to six weeks.

The operators include:
Andrew Walsh of Derrymore, Roscrea
Raymond Heney, aged 54, of Camas, Cashel
Noel Browne of Bansha
Larry Hickey, 73, of Ardmayle, Cashel
Anthony Flynn, 51, of Golden Road, Cashel

During the proceedings, Mr Justice David Keane empaneled a jury of seven men and five women to hear the case. He stated that the allegations revolve around the accused’s operations in providing school transport across Limerick, Tipperary, Clare, South Galway, and Waterford.

This trial marks a significant moment in the ongoing scrutiny of competition practices within the transport sector, particularly regarding services for schoolchildren. The outcome could lead to serious ramifications for the accused operators and set a precedent for future competition law enforcement in Ireland.

As the trial continues, all eyes are on the developments that will unfold in the coming weeks. Observers are urged to follow updates on this critical case, as it touches on essential issues of fair competition and service provision in the education sector.
