Brown Thomas and Arnotts Admit Pricing Violations During Sales

The Brown Thomas Arnotts Group has acknowledged breaching pricing regulations during the Black Friday sales in 2024. The retailer, appearing before Dublin’s District Court, attributed these pricing discrepancies to miscommunication with concessions operating in its stores and online. The group was unaware of the violations until several months after the sales period ended.

During a court session on Monday, the Brown Thomas Arnotts Group pleaded guilty to violating laws designed to protect consumers from misleading pricing practices. These regulations require retailers to base discounts on the lowest price within at least the previous 30 days and to display those prices transparently in advertisements and price tags.

Investigation Reveals Multiple Breaches

The Competition and Consumer Protection Commission (CCPC) identified a total of 18 instances of misleading pricing on the Brown Thomas and Arnotts websites during the 2023/24 winter sales season, which included both Black Friday and Cyber Monday. Among the misrepresented products was a Samsung Galaxy watch advertised at €379.95, marked down from €459.95. Investigators discovered it had been available for €369.95 less than 30 days prior to the sales. Similarly, a Sony Bravia television was listed as being on sale for €239.95, reduced from €259.99, but had previously been priced at €179.95.

Alison Fynes BL, representing the Brown Thomas Arnotts Group, explained that the retailer operates a mixed business model, selling its own products alongside those from concessions. While the retailer accepted responsibility for the pricing errors, Fynes noted that they arose from miscommunication with concession vendors. She stated that the retailer did not become aware of the breaches until contacted by the CCPC in April 2023.

Legal Consequences and Industry Impact

Judge Michael Ramsey dismissed the charges on the condition that the retailer pays a fine of €1,000 to the Little Flower Penny Dinners charity within 30 days. This case places Brown Thomas alongside other retailers, including Boots, Lifestyle Sports, and DID Electrical, who have also faced penalties for similar pricing violations under the legislation introduced in 2022. These companies have pleaded guilty to comparable breaches following a pricing sweep conducted by the CCPC.

Under Irish law, retailers are permitted to set their prices independently but must clearly display them to avoid misleading consumers. The tightening of pricing regulations in 2022 aimed to address concerns about retailers misrepresenting discounts, leading to consumer confusion regarding actual savings. The maximum fine for breaching these laws is €5,000.

According to CCPC spokesman Patrick Kenny, this case underscores the importance of transparent pricing for consumers. “Today marks another important outcome for the CCPC in ensuring consumers can shop with confidence, and that retailers can compete fairly on a level playing field,” he stated. Kenny emphasized that consumers have a legal right to clear and transparent pricing, particularly during sales periods when quick purchasing decisions are often made based on the advertised prices.
