Businesses Urge EU Clarity as Packaging Law Deadline Approaches
The deadline for the EU Packaging and Packaging Waste Regulation (PPWR) is fast approaching, with implementation set for August 12, 2026. As this date draws nearer, businesses across Europe are increasingly concerned about the lack of clarity regarding compliance requirements. The European institutions are now urged to take decisive action and provide the necessary guidance for the industry to ensure a smooth transition.
The European soft drinks sector has made significant strides toward supporting a circular economy for beverage packaging. According to UNESDA Soft Drinks Europe, the industry has long been committed to sustainable practices. Key initiatives include the use of fully recyclable packaging, investment in effective waste management systems, and the promotion of reusable beverage options.
Recent statistics highlight the progress made: as of 2024, approximately 51.7% of the polyethylene terephthalate (PET) used in plastic bottles was recycled material, surpassing the 2025 target of 50%. Additionally, there are currently 16 EU countries with a Deposit Return System (DRS) in place, with further expansion anticipated due to ongoing investments from industry members.
Despite these advancements, businesses are facing critical uncertainties as the PPWR implementation date looms. The lack of concrete guidelines means companies are struggling to prepare for compliance, which threatens their operational efficiency and competitiveness. The anticipated PPWR Legal Notice is seen as a step toward providing clarity; however, stakeholders emphasize that it will not address all existing uncertainties.
Urgent Need for Regulatory Clarity
With just five months remaining until the PPWR takes effect, businesses cannot afford to wait for the regulatory environment to stabilize. The urgency of the situation requires immediate action from EU institutions to facilitate a clearer path forward. Companies need reliable information to plan investments, prepare for compliance, and maintain their supply chains.
EU institutions must expedite the adoption of harmonized, technically sound guidance that can be implemented without delay. This includes timely secondary legislation that simplifies complex or unclear requirements. One pressing issue is the absence of a unified methodology for addressing per- and polyfluoroalkyl substances (PFAS) in food contact packaging. Currently, individual Member States have the discretion to adopt varying approaches, which could undermine the harmonization of the Single Market and disrupt the free movement of goods.
The lack of guidance on single-use plastic grouped packaging is another area of concern. Without a clear framework before 2027, the soft drinks sector faces significant challenges in adjusting packaging formats in time for the 2030 PPWR deadline. Transitioning to compliant solutions is estimated to cost the industry over €2 billion.
Call for Collaborative Solutions
The soft drinks sector recognizes the importance of reusable models in reducing packaging waste. Co-legislators have acknowledged the need for context-based exemptions that make sense environmentally and economically. However, the current exemptions framework does not adequately reflect the progress made by some Member States in enhancing beverage packaging circularity through effective collection and recycling systems.
With the 2030 deadline approaching rapidly, it is urgent for EU institutions to provide clear guidelines on exemptions and compliance. Businesses require definitive information on which types of packaging will be permitted or banned to make informed investment decisions. The need for timely guidance cannot be overstated; it is essential for companies to have the predictability necessary to achieve full compliance with the PPWR.
The responsibility for addressing these pressing issues does not rest with a single EU institution. All relevant bodies must acknowledge the urgency of the situation and collaborate to provide the regulatory clarity that businesses desperately need. As the countdown continues, stakeholders across the industry are calling for prompt and effective action to support a successful transition to a sustainable packaging future in Europe.
