EU Launches Investigation into Shein for Selling Illegal Products
The European Commission has initiated an investigation into the online retailer Shein, focusing on its practices regarding the sale of illegal products, including “child-like sex dolls” and weapons. This inquiry could result in substantial fines for Shein if it is found to have violated the European Digital Services Act. The investigation will also examine the potential risks associated with the “addictive design” of the platform and the transparency of its recommendation systems.
Investigation Details and Potential Consequences
The Commission’s inquiry will be supported by Coimisiún na Mean, Ireland’s communications regulator, as Shein’s European headquarters is located in Dublin. The Irish authority is seeking additional information from Shein regarding its measures to prevent minors from accessing age-inappropriate products. “In the EU, illegal products are prohibited – whether they are on a store shelf or on an online marketplace,” stated Henna Virkkunen, the EU’s tech chief. She emphasized the importance of the Digital Services Act in ensuring consumer safety and wellbeing.
The European Commission’s investigation will focus on three main areas. Firstly, it will assess Shein’s systems for limiting the sale of illegal products within the EU. This includes examining content that could be classified as child sexual abuse material, such as the aforementioned “child-like sex dolls.” Secondly, the Commission will explore how Shein’s potentially addictive features may adversely affect users’ wellbeing. The platform reportedly incentivizes user engagement through rewards and points, raising concerns about the implications of such design choices.
Lastly, the investigation will evaluate whether Shein complies with the Digital Services Act’s requirements for transparency. This includes disclosing the key parameters of its recommendation systems and ensuring users are provided with at least one easily accessible option that does not rely on profiling.
Next Steps in the Investigation
Following the formal launch of the investigation, the European Commission will continue to collect evidence to support its findings. “The opening of formal proceedings empowers the Commission to take further enforcement steps, including interim measures or the adoption of a non-compliance decision,” the Commission noted. In this context, it also stated that it can accept commitments from Shein aimed at remedying any identified issues.
The investigation was prompted by three previous requests for information regarding Shein’s compliance with the Digital Services Act. While no specific timeline for the investigation has been provided, it is worth noting that a fine of €120 million was imposed on another company, X, after a two-year inquiry concluded last year. Under European law, potential fines for violations can reach hundreds of millions of euros, depending on the severity of the breach and the company’s circumstances.
Shein has been approached for comment regarding the investigation and any potential implications it may face. As the situation develops, the European Commission’s findings could have significant repercussions for the online retail giant.
