High Court Dismisses Denis O’Brien’s GDPR Case Against DPC

UPDATE: The High Court has just dismissed an appeal by businessman Denis O’Brien, marking a significant setback in his ongoing legal battle against the Data Protection Commission (DPC). This decision comes after O’Brien challenged the DPC’s ruling regarding his data request related to the controversial Red Flag Consulting dossier.

In a judgment released this evening, Justice Siobhán Lankford stated that O’Brien “has not succeeded on any of the grounds argued before the Court.” This ruling stems from a data access request O’Brien made in 2018 under the General Data Protection Regulation (GDPR), seeking personal data from Red Flag regarding a dossier prepared for an unidentified client.

O’Brien’s request was only partially fulfilled, as Red Flag cited a duty of confidentiality to its client. Following this, he lodged a complaint with the DPC on July 2, 2020. After a thorough examination, the DPC upheld Red Flag’s position, asserting that the refusal to disclose certain personal data was justified to protect client confidentiality.

The High Court’s ruling not only dismisses O’Brien’s appeal but also orders him to cover the legal costs incurred by both the DPC and Red Flag. The Attorney General was also involved in this case, but given its public importance, Justice Lankford directed that he would bear his own costs.
