Enoch Burke Released from Mountjoy Prison Ahead of Legal Hearing
Enoch Burke has been released from Mountjoy Prison following a High Court order that permits him to prepare for an upcoming legal hearing. Mr Burke, who has served over 560 days in prison, indicated his intention to return to his position at Wilson’s Hospital School in Co Westmeath immediately upon his release.
During the court session with Mr Justice Brian Cregan, Burke asserted his ongoing employment status at the school, despite having been dismissed due to his refusal to address a transgender student using their preferred name and pronouns. The judge remarked on Burke’s “unparalleled ability” to complicate his own situation and specified that the school must report any further trespassing by Burke, which could result in his immediate return to prison.
The current legal matter involves Burke challenging the composition of a disciplinary appeals panel that is set to hear his appeal against dismissal. This panel was due to convene on January 10, 2024, but the proceedings were postponed after Burke initiated new High Court actions, claiming bias on the part of one member, Geraldine O’Brien, who he argued had prejudged the case.
In a previous court ruling, Burke successfully contested the participation of another member of the panel. On Wednesday, Justice Cregan stated that after reviewing the case materials, he concluded it was necessary for Burke to have sufficient time to focus on the critical issues at hand and adequately prepare for the upcoming hearing.
“I am doing this for one reason only, and it is in the interests of justice,” Justice Cregan explained. Despite this, he reaffirmed that the existing court order prohibiting Burke from trespassing at the school remains active.
While participating in the hearing via video link, Burke expressed skepticism about the judge’s motivations for his release. He stated, “I do not find it in the slightest bit credible that the release is because the court is interested in the interests of justice.” Justice Cregan responded, clarifying that the decision to release Burke was rooted in ensuring proper legal proceedings, regardless of Burke’s perceptions.
Burke reiterated his commitment to returning to the school, stating, “Whether today or tomorrow, I will be at my workplace.” His remarks prompted Rosemary Mallon, the barrister representing the school, to request a court mention on Thursday or for the judge to reconsider the release in light of Burke’s comments.
The hearing took a contentious turn when Burke accused the court of not being straightforward about the reasons for his release. Justice Cregan dismissed these claims, emphasizing that the opportunity for Burke to prepare his case should be viewed positively.
Tensions escalated further when Burke’s brother, Simeon Burke, attempted to intervene in the proceedings. Despite identifying himself as Enoch’s brother, he was informed by the judge that he could not represent his brother in court. When he refused to leave, the judge ordered his removal, leading to his voluntary exit.
As the session resumed, the judge reiterated that Burke would be returned to prison if he trespassed at the school again. Burke’s assertion that the court was releasing him due to being “caught” was met with disapproval, prompting the judge to mute his audio.
The challenge against the disciplinary appeals panel has been adjourned until early February 2024. Burke’s legal saga continues to draw attention as both sides prepare for the next phase of this complex case.
